MAGISTRATE’S COURT

TUESDAY, JULY 15. (Before Mr H. W. Bundle, S.M.) JUDGMENT BY DEFAULT. Judgment, for the plaintiffs was given by default/ in the following cases :—The Graham Coal Company Ltd. v. H. W. Paul, £2 9s 6d, goods supplied, with costs. (£1 9s 6d); Daniel Eckhbff, v. M. : Kjiye (Mamaku), £25 15s, balance, owing, with costs (£4 13s 6d). U CLAIM FOR DAMAGES. Claiming damages amounting to £4B 6s as a result of a collision, Richard Albert Francis Dyson (Mr W. McAlevy) proceeded against the Shell Company of New Zealand Ltd. (Mr A. N. Haggitt). The sum was made up of repairs to motor cycle, £10; lost of wages, £2B 6s; and general damages, £lO. The collisioh occurred at llavensbourne, .where Dyson lived, said Mr McAlevey. The facts were that he was returning from work in the city by motor cycle, and near the fertiliser works caught up with a truck belonging to the Shell Company. Dyson made no attempt to pass, but followed tho truck. On reaching another truck, parked on the left of the road, the Shell lorry swerved to the right and then to the left to draw up with the wheels in the gutter and the rear of the body projecting over the road. It did not slacken speed, and only a narrow portion on the wrong side of the road was left to-Dyson, who touched the rear, of the lorry and was thrown to the ground. Negligence on the part of the Shell driver was alleged. Evidence in support of this statement was being given by Dyson when the court adjourned until this afternoon.
