SALES TAX UNPAID
WRIT ISSUED OH DUHEOIH TAILORS TEST CASE TO BE BROBfiHT A writ has been issued by the Customs Department and served on Mr T. Jenkins, as secretary of the Dunedin Master Tailors’ Association, claiming payment of sales tax. This confirm* the information received some week* ago that the department intended to bring a test case for non-payment of the tax by Dunedin tailors. In a recent interview with the ‘ Star ’ Mr Jenkins set out the grounds upon which; - the tailors here were not paying th* tax, and said that it involved the principle that taxation was not legal outsid* the provisions of the Act as laid down by Parliament. As no provision wa* made for appeal, except the farcical on* to the department concerned, they had adopted the practice of the patriots’* rebellion. The department’s policy wa* one of conciliation with the individual, explaining the remark of the forme* Comptroller of Customs that Mr Coate* objected to so much publicity. “ Tha next more, that of prosecution, is th* duty of tne department,” stated Ml; Jenkins. “ The department should also state whether Parliament was told that the tax was to be one between wholesale and retail only. Another question is: Why is the tax charged differently on. different manufacturing retailers?’*
