THE NAYLOR CASE
DISQUALIFICATION INVALID [Per United Press Association.] SYDNEY, May 7. Jn the Equity Court to-day Mr Justice Long-limes gave judgment in the case Naylor versus the Australian Jockey CJidi. He held that Naylor’s disqualification was invalid as the A.J.C. had no jurisdiction. Naylor must he regarded as an ordinary member of the public, entitled to go upon the Randwick racecourse. The A.J.C. had contended that Naylor was not an ordinary member of the public, but was •a person plying a trade, and that plaintiff's character was such that ho my-Et, under the club’s rules, be excluded from admission.
In granting Naylor a continuation of the injunction, the Judge said there was nothing to prevent the A.J.C from taking such ■ :u:. • r course in the mrer'dfio ot its right under the statute and it was satisfactory to know that the A.J.C. Committee was not mistaken in its conclusions with regard to the character of the evidence that Naylor had given at the club’s inquiry. [A previous message read as follows; —Argument was begun to-day on Rufus Naylor’s application for continuation of the injunction against the Australian Jockey Club. An affidavit prepared by Mr Howe, the secretary of the A.J.C., was read, and disclosed that Naylor was disqualified on the ground that he gave false or misleading evidence in connection with the ownership of a horse named Mavado, which allegedly was not allowed to do its best at Gosford, a country meeting, in February,
