Pilling, £2 3s, goods supplied. CLAIMS FOR POSSESSION. Edmund' James Smith applied for possession of property at 1 56' Helena street, occupied by Thomas Christopher Fogarty (builder), and Richard James Fogarty (carpenter). Counsel for plaintiff said that £467 was outstanding, the original amount of the mortgage being £2ll. Every opportunity had been given the defendants to pay, but any offers made were not carried out. When defendants were in work they would not even attempt to pay 10s per week. Rates and interest etc. were mounting up at the rate of £73 per year, and the plaintiff was now anxious to get possession. Richard James Fogarty said that he was in very difficult circumstances. He had a family of ten, only one of whom was working, earning 7s a week. There were thirteen of them crowded into a house of five rooms, and he and his brother were engaged on relief work. His Worship: llie plaintiff has given you a great deal of/latitude, and the position was getting worse. He had the right to realise on his security. An order lor possession on or before February 9 would be made. The Public Trustee, as executor of the will of William Fort, applied for au order for possession against AVilliam Grant Banberry, of 143 Norwood street, N.E.V. The plaintiff claimed that the defendant agreed to rent a certain tenement at weekly rent of £l. The rental was reduced by agreement between plaintiff and defendant from June 24, to 15s a week, but now £42 2s Cd was due. His Worship made an order for possession on or before February 9»
