CITY POLICE COURT.

After we went to press yesterday the case of C. F. Alexander (tramways traffic manager) y. Janies Brown was heard bv His Worship, Mr G. Cruickshank, S.M. The defendant was charged with that, after having paid his fare for a certain distance, ho did unlawfully proceed in a tramway car beyond such distance, and did not pay the required additional fare. A second information charged him with having behaved in an offensive manner to the annoyance of others. Mr W. C. MacGregor appeared on behalf of the Corporation, and Mr John MacGregor for the defendant, who pleaded not guilty.—Mr W. 0. MacGregor said that Brown, after having travelled a certain distance on the tram'to Anderson Bay on the 3rd inst., refused to pay an extra fare when asked to do so, and when eventually persuaded to leave the car indulged in strong and indecent language. He was about half-drunk. Some days after the summons had been served defendant called on the traffic manager at the tramways office, and wished the proceedings to be abandoned. On that occasion he appeared to bo partly intoxicated. The present information was laid under the Tramwaya Act, 1894, second schedule, section 39, subsection 2.—Pcrcival W. Power, tram conductor, Charles Pearce, motorman, and Charles F. Alexander, traffic manager, gave evidence in accordance with counsel’s explanation. For the defence, James Brown gave evidence on Lis own behalf. He denied the assertions made respecting his sobriety on the date mentioned, and also the general evidence tendered by the prosecution.—His Worship, on the first charge, ordered defendant to pay court costs (7s) and solicitor's foe (£1 Is). In the second case he was fined 20s, with court costs and professional fees.
