THE APPEAL COURT.
In the Appeal Court yesterday argument was taken in the case Regina v, Peter Blrrell. Defendant, lately a clerk in the Deputy Official Assignee’s office, Timaru, was charged with embezzlement. The ease was tried before Mr Justice Denniaton at the August sittings of the Supreme Court, Timaru, when His Honor directed the jury that, if an entry upon a dividend sheet could defraud any person, they would be justified, upon the evidence, in finding an intention so to defraud. Prisoner was found guilty, but sentence was not pronounced, pending the opinion of the Court of Appeal. After hearing argument the conviction was confirmed.
