MEETING OF CREDITORS.
A meeting of the creditors of J. W. Cummings was held this afternoon. The creditors present were:—Messrs E. S. Hay, Jobberns (Marshall and Copeland), Greenslade (Speight and Co.), Barron (Banks, Barron, and Co.), and A. Thomson (Thomson and Co.) . The bankrupt's declaration showed his assets to be L 73 and his debts LIBO 12s. The Bankrupt was examined, and stated that he had been in business as a hotelkeeper since February, 1879. Ho was in the Rose, Shamrock, and Thistle Hotel at Green Island for about fourteen months, and he sold out to Marshall and Copeland for about L 528. He paid LSOO to James Marshall, who held a bill of sale. He then went into the Scotia Hotel, and after two years sold out for LSOO. James Cummings, his father, got L4OO, for which he held a bill of sale. He afterwards took the Mornington Hotel for L 520. His father paid L4OO and ho paid the balance, his father taking a bill of sale. In July he sold out to Mr Sachtler for L 443. His father got L 220 and released the bill of sale. His father was once a partner with him. Ho thought he was Bolvent when ho sold out, but he found out he was not afterwards. He therefore attempted to clear off a number of creditors, and paid as far as he could go. Tho Assignee said the action of the debtor looked like an honest attempt to pay a proportion of tho money he owed to his creditors, but ho had miscalculated the amount of his debts.
