PROBATION ALLOWED

Arthur James Burt, electrician, 41 (Mr. R. L. A. Cresswell), was admitted to two years' probation in the Supreme Court today by the Chief Justice (Sir Michael Myers) for obscene exposure, to which he had pleaded guilty at Palmerston North on May 24. Counsel submitted that although the prisoner had been previously convicted of a similar offence, that had occurred nearly 17 years ago. He was married in 1936 and lost his wife and child in childbirth in 1939. Normally he was a moderate drinker, and the offence had been committed on a day when he had over-indulged in liquor. He had excellent references and was a good worker. His Honour said that as there was nothing to indicate that the prisoner had been guilty of the same practice since 1927, and he was doing work that was useful to the community, he felt justified in taking the risk of granting probation. The prisoner was ordered to pay the costs of the prosecution and to observe a prohibition order during the period of probation. Mr. W. R. Birks appeared for the Crown.
