SUCCESSFUL CLAIM
INJURY TO A WORKER In the Arbitration Court today judgment was given in a compensation case in which Joseph MacChesney, of Te Horo, was plaintiff and George Molesworth Tolhurst.j of Wellington, was defendant. The plaintiff claimed that while working for the 'defendant at Te Horo. as a casual employee, on May 29, 1934, he was injured; when throwing posts over a fence a furrow on which he was standing collapsed; and he sustained a hernia. Mr. Justice Page said that a majority of the Court had decided that the plaintiff's case had been made out, and the plaintiff was entitled to payment for the three weeks during his period of enforced idleness by reason of the accident. Judgment was entered for the plaintiff, with costs. In a dissenting judgment, Mr. A. L. Montieth said he thought that a suspensory award should be made as there was reasonable possibility of further incapacity and loss .of earning power by the plaintiff. ; Mr. D. W. Virtue appeared for plaintiff and Mr. "E. Parry for the defendant.
