APPLICATION DISMISSED

In the Supreme Court today Mr. I Justice MacGregor heard a petition for divorce by Ernest Cook, of Makara, dairy farmer, against Marguerite- Trissie Cook. The ground of the petition was separation by mutual consent in May, 1929, which separation, it was alleged, had continued down to the present time. ' ■'■..■ The petitioner, in giving his evidence, admitted that his wife had gone to stay with her mother in Johnsonvillo fov the purpose of looking after her during her illness; her illness still continued. The petitioner said that he supposed his wife would have returned to him if her mother had recovered her health. Counsel for the respondent submitted that the separation was not such as to entitle the petitioner to a divorce, but was merely, ah arrangement whereby Mrs. Cook could look after her mother during her illness, and was not a separation intended by the Legislature to give a ground for a divorce petition. His Honour dismissed the petition, with costs. Mr; A. Young appeared for the petitioner, and Mr. A. D. Sievwright for the respondent.
