Charged with driving in a manner which might have been dangerous, to the public, Eenncth Frank Mitphinson pleaded not guilty before Mr. JwG-. L. Hewitt, S.M., in the Petorio 'Couit yestciday. _ , Eobcit Alexander Scott * said that about 6 p.m. on February 16 ho had turned from Cuba Street into Wakefield Street, and.^vas proceeding at from 12 to 13 >m.p.h, when 'jj^ put out his hand ns a sign, that he1 'was^ about to ""turn into his garage. Ho then , heard'-1 a screeching ■'of brakes^ and a motor- } van' went past him and hit a concrete gatepost. ■ Constable G. B. King read a statement in which the defendant' stated that he was driving at from 25 to 30 m.p.h.' ,-Ho '.thought »,th6, car in'fronf of him was Agoing "to stop, as ti& had seen no sign of, an indication to turn, so ho accelerated, but tho car in front then fumed, and he'applied his brakes. After questioning Scott, tho Magistrate said that the signal-he gave was inadequate, but by accelerating to pass the cai the defendant made an. error of ludgment. Senior-Sergeant C. E. Boach said that the borough spee,d limit past intersections was 15 m.p.h., and on his own admission the defendant /had exceeded this speedy doing fiom 25 to 30 m.p.h. Mr. Hewitt remarked that Mitchinson was wrong in doing this speed. Ho imposed a ilnc of 10s. V
