FRAUD ALLEGED
PURCHASE OF FRUIT FARM

The action in ■which a former officer in the Hoj-al Navy, Jphn Arthur Middleton 'Old Goodford, of Hamilton, but previously of Yeovil,- Somerset, England, is proceeding against New 'Zealand Citrus Plantations, Limited,' and a former director of the company, William Henry Ball, of Auckland, and the company's former agent in London, David Eufus Williams, salesman, London, tvas continued in the Supreme Court today. ' The defendant company was stated to be an liquidation, and ivas not represented. The action arose out of a purchase of land in North Auckland for the cultivation of citrus fruits. Alleging that there had been fraudulent misrepresentation, the plaintiff claimed against the. company rescission, of a con* tract to purchase 12 acres of land about seven miles from Kaca, North Auckland. Against' the individual defendants he - claimed £840, the sum paid in respect of the property, together with £.198 as transport; expenses from England to New Zealand. A further £200 was claimed as general.damages.l For the defence, counsel said it had to be proved, that Ball'was an actual party to the fraud, if there were one. There was nothing to connect Ball with any, of the alleged, 'misrepresentations made by Williams in England. Tie-hearing-was adjour^d.
