AN ENGLISH TEST CASE
A ruling against loud-speaker reproductions of 8.8.C. broadcasts to guests in hotels and public houses in England was given by Mr. Justice Maugham in a test case in the Chancery Division on April 5. The action . was brought by the Performing Rights Society for an injunction restraining Hammond's Bradford Brewery Company from permitting the George Hotel, Brighousc, to be used for the public performance of any musical work in which the society held rights. . Mr. Justice Maugham ruled that the reproduction was a, performance and that the use of the tuiiing-in apparatus and the loudspeaker for the benefit of the guests of the hotel was an act not justified or authorised by the licence given by the corporation. Accordingly he ruled that the performance was an infz'ingement, and he granted a declaration to that effect with costs. The decision is likely to be tested., in the. .Court of Appeal. ■•'■.'
