The Arbitration Court hoard a claim for compensation under tho Act by Elizabeth Coutts, a -widow, of Christ- | church, arising out of an accidont in j which John Coutts,' a Public Works employee,' received fatal' injuries aa tho result of a landslip near Westporfc on 3rd April that swept ovor a camp owned Iby tho^Dopartment.

The Department denied liability. The Court held that there was nothing to prevent Coutts from living ia his own. camp. When a man had a right, not a duty, to live in his employer's hut, the employer was'-not liable.

Judgment waa given for the Crown.
