He waß removed to the hospital. A younger brother, Allan, when about to board a slow train for Dunedin, was arrested and placed in custody to appear on a charge of attempted murder.'. It is alleged, that Herbert intervened when Allan was about- to punish a boy for throwing clods of earth at him while working in a garden, and that Allan ran away saying, "I'll get you tor this." As he was about to leave for his sleeping hut, Herbert was shot in the left ■shoulder. The bullet stfuck the bone, "mushroomed," and rebounded into his clothing..
