AN HOTEL LEASE
CIVIL ACTION IN SUPREME; COURT. The hearing of legal argument was commenced,this morning in the Supreme Court'before Mr. Justice Salmond of an action brought by Arthur Daniel Kennedy and Miriam Winifred Kennedy against John Berryman and Elizabeth Berrymau, and concerning the lease of the Post Office Hotel. Mr. C. P. Sk'errett, K.C., and with him. Mr. W Perry, appeared for plaintiffs, and Mr' J J iPGratb for defendants. • The' first'claim was to compel defendants to execute the lease of"the hotel .under .a right of renewal in a prior lease._ Defendants were stated to have exercised ."the right of renewal, but subsequently, on the lease beinT tendered for signature, declined to sign the same, contending that .they were not bound to do so until 24th November next. Plaintiffs held that it should bo signed immediately. .-■ A. second "claim was also made sbeing for-£96'4 S »7d;-being interest on'a sum of £3000, lent by defendants to the plaintiff on security of certain shares held by the plaintiff, Mrs. Kennedy, such £3000 being considered part of the amount of goodwill payable for renewal of the lease," and due to have been repaid by the plaintiffs to defendants upon execution of the lease. Plaintiffs claimed that defendants refused to execute' the lease,, and refused to return the ' script for the shares. Plaintiff, therefore, repaid £3COO to the defendants, and sought to recover the interest on'that amount from the date of payj ment, until 24th November. (Proceeding.)
