the case of J. Gt. Marshall, of "Wellington, City Council employee, against V. Qujnn, Hansou street, steward. The claim wag for a return of a deposit of £100 paid by the plaintiff to Messrs. Ryde and Comj| iauy as agents for the defendant on the' sale of a.house in Hanson street. It 'was alleged by the plaintiff that the del endant had failed to complete, the contrt ict, and had definitely repudiated tho sale; and on behalf of the defendant, it wj ss set up that tho plaintiff had not earrioc I out the nc#ssary formalities, and h art led the defendant to understand thai i he was going on wifh tho purnhasfi. The Magistrate, on reviewing the evidence, staled that tlio version givou by tl to plaintiff was the probable one, and that the defendant was at fault in igno ring the letters sent him by the solicitoi s for the plaintiff, and asking him whs ther he was prepared to complete the oJiitract.
