Are opinion and heresay admissible as evidence? This point came up for consideration at Saturday's sitting, of the North Island Bailwasy Appeal Board, when evidence was being heard, in the case of Mr. E. S. Kelly. . A witness was expressing hia opinion of appellants capabilities when Mr. 0. E. Bell, who was appearing on behalf of appellant, raised an objection, on the ground/ that neither opinion nor hearsay was allowable as evidence. The Act providedi that t.he board had unlimited power to prescribe its own procedure, but Mr." Bell submitted, that that power d.id> not include admission of evidence which, legally was not evidence. The chainrian (Mr. E. Page, S.M.), ruled that the evidence should proceed meanwhile, and reeerved decision on the ooint. Messrs'. E.'. Johnston and Co. will sell furniture at 18, Telford-terrace, to-mor-row at 10 30 a.m., and on Wednesday, at 10.30 a.m., in their rooms. On Thursday, at 10.30 a.m., they will sell shop fittings, gloss, etc., on the premises vacated by James Smith at Dixon-streot.
