AN INSURANCE CONTRACT
CASE BEFORE APPEAL COURT.
The Appeal Court is engaged to-day, with the hearing of an, appeal the decision of Mr. Jnstice Sim in the case, New Zealand Insurance Company v. Tsie Tyneside Proprietary, Ltd., coalmine proprietors. The Chi«f Justice (Sir Robert Stont) is presiding, and associated with him aTe Mr. Justice Denniston, Mr. Justice Cooper, and Mr. Justice Chapman. Mr. C. P. Skerrett, K.C., with Mr. 0. T. J. Alporti of Christ-church, appeared for the appellant, and Mr. M. Myers for the respondent. The case arose out of a contract of insurance between the parties, the defendant denying that Derek Edward Thornton, as the company's agent, was authorised: to make the contract, which it had repudiated. The plaintiff claimed £231 17s lid as damages for breach ofi warranty of authority, or, ate an alternative, for unpaid premiums. His Honour Mr. Justice Sim gave judgment for defendant, with ,costs, and it is against! this decision that the New Zealand! Insurance , Company is appealing. (Proceeding.)
