Laery and Co., Limited, produce merchants, of •Wellington, proceeded against Robertson Bros,, Ltd., produce merchants, of Auckland, on a claim for £l 62s 6d fof balance of the price of chaff sold. Defendants counter-claimed for the same amount, saying that they had suffered damago to that extent by reason of the plaintiffs' failure to deliver the chaff at the rate of three trucks a week, as provided by the contract. The question in dispute wae whether the Vendor or the mirehaser must bear the loss occasioned by the impossibility of finding freightage for the goods from Picton to Onehunga. Mr. A. A. S. Menteath appeared for plaintiffs and Mr. H. IS, Evans for defendants. After hearing evidence, the case wm ad< iourned for legal argument,
