Ellis Mary Kibblewhite — a summons on lien o'i' £272 19s 3d, on tho property of defendant, for whom plaintiff had supplied timber for tho erection of a house for defendant ab Petone. Defendant, through Mr. Arnold, asked the "court for a motion to dismiss and set aside | the lien, on the ground that the proceedings taken by plaintiff were totally defective and irregular. For plaintiff, Mr. Herdman, who appeared for Mr. M'Grath, contended that, in the issue of the lien, the proj vision of the Wages Protection and Contractors' Lein Act, 1902, had been adhered *o. Payment had been demanded for the amount claimed, and had nob been made. The lien had, therefore, been issued with a viow of enforcing the clai/n. After further argument, it was decided by his Honour that the case should be treated as adjourned, and that it be ascertained when the evidence on the summons should be heard. The case was put on the Banco list, and set down for 2nd November. Manahe le Hiakai, represented oy Mr. Blair, made application to the court that the District Land Registrar should substantiate the grounds of his rofusal to cancel the transfer of certain lands (mentioned) made in favour of one Robert Dransfield. Mr. Treadwell, who appeared for the Registrar and Dransfield, urged, on behalf of the former, that he did not desire to take any active part in the matter ; and ou behalf of Dransfield, a preliminary objection to the form of proceedings.
