TEE RIZZI-BAKER CASE.

JUDGMENT IN FAVOUR OF PLAINTIFF. In the Magistrate's Court this morningMr. H. Eyre-Kenny, S.M., gave judgment^ in the long-drawn-out civil action of A. Rizzi v. L. G. Baker, a claim for £88 11s 2d. Three main issues had, he said, been raised, the first of which was as to the arrangement between Rizzi and Baker on the question of salary. The evidence on this, he said, was very conflicting, each side haying its weak as well as its strong points. The testimony for plaintiff and defendant seemed so evenly balanced, that .be could only come to the conclusion that whilst it proved that it was agreed that plaintiff should receive remuneration for his services, it .was impossible to say with certainty what the amount arranged was. The Bench therefore considered that £3 10s per week would be a fair wage for Baker, having regard to his position as manager. The number of weeks daring whloh he was engaged was 30. The second question was — Is the plaintiff entitled to credit for £8 15s, rent of house in College-street ? and though the evidence was conflicting, the Magistrate thought he was entitled to it. As to the £9 paid to Baker, the Court held that only £5 was on account of wages. Mr. Kenny alluded to the side-issues introduced into the case, and then gave a carefully-prepared statement of how he considered the account stood between Rizzi and Baker, leaving a balance of £39 11s 2d in favour of plaintiff, for which amount judgment was accordingly given, w: th costs on that sum.
