The Messenger Wife-desertion Case.
[Bt Telegraph.] [united press association.! Christchorch, This Day. W. H. Messenger, tho absconding publican, appeared at tho E.M. Court to-day, charged with doscrting his family and going to reside outside tho colony. Mr. Martin, for the prosecution, applied for a withdrawal of the charge, as Messenger and wife lad been reconciled. Mr. Stringor, for MeaHixngor, called attention to a defect in the legislation which would bo fatal to tho prosooution. The Destituto Persona Amondmont Act, 188-t, under which the information was laid, made no provision for the wife to givo evidence against hor husband . It would therefore be practically impossible to provo the chivrgo, as the wife wotlld bo v. Jicuoßsary witness. Mr. Boctham, 8.M., snid lie would give his decision to-morrow.
