A meeting of the creditors of A. Robertson, baker, etc.. was held, yesterday before Mr Jardine, Deputy Official Assignee, at the Courthouse. Claims wero put in as fol- V lows :—Nnpthali £9 10s, Jull and Co., £i ** Os -id, Maroney £-13 14s 3d, MoLeod Bros. £3 13s, Bibbey 9s, Lyons £1 10a Id, Rathbone £1 18s, Evans and Co., £46 7s Bd, Hart and Co £30 8s 9d, Thornton £7 10s, Rasmuason £5 ss, Loughnan £G 13s, Irelaud £42, Corskie £3 17s 6d, Mail £1 10s, B. B. Johnson £9 9s lid, Hitchman £7 ss. The assets were book debts roughly estimated wt £100, cash in bank £11, goodwill etc., of businesseso. Apparent dobtor'a balance £3 10s Gd. Mr Loughnan appeared for the debtor and Mr E. H. Lee for sundry creditors and Mr Molntyre. The debtors statement attributed his failure to falling off of business and his wife leaving him, which spoiled his front shop business. His examination by the Assignee detailed the following particulars :—Hart and Co sued him a fortnight before he filed for a dia. p.n. which came duo 7th October. He paid hailiil a cheque for full amount. Thornton sued him about middlo of October, ancK Evans ou 12th November aud Jull on sam&V' day. On 28th October ho sold his business to Molntyre, who took possession on Ist November, receiving £RO, which he paid into bank; he only paid Tyler, hia landlord, £G after 2Slh October. He paid his wifo £10, having agreed to pay her 10s weekly last June ; he also paid Bennett £2 12s as rent for paddooking, 2 horsos sold to Mclntyre and Cowper £2~5s ; did not know what ho did with othor £4 ; out of £7 cash he paid Mr Loughnan £3 and Molntyre 30s wages. He had not received any money since his bankruptcy. The only books ho kept were a delivery-book, day-book, and ledger, the latter only showed what was owing to him and not by him; he had a good idea what his position was, but could not tell exactly, could only mako a guess at his position in July; ho had no property in July that he had not on 28th October; did not kuow what his liabilities were in July, but had been in difficulties for the last two years and very much pressed for money : his liabilities were heavier in July than now ; ho dishonored his bills all along, but paid them afterwards ; kept no bill book; P.N.s were sent him through the post,' which ho accepted and returned. Ho married a widow early in 1883, (.ho had money in her own right—£2sQ. When ho started ho had £75 capital and two horses; when he married his wife put her money mi the business which ho bought from Tyler - his wife paying £100 to Tyler for the • groceries, she bought furniture out of the i balance, which was insured for £100 ; his wife had taken his receipts ; tho furniture was all burnt iv the lire of I.Bt>, Jand Lis wifo got the insurance money, which was paid intc her own account at tho bank. Since thon she bad advanced him £30; she bought fresh furniture in Napier and kept the receipts. When his wifo began business in IDanovirke it was advertised in the papers ; his namo was used till August when she used her own. In Juno they parted on good ternm ho was to supply goods and ehe was to Bend him the money every month ; ho was then in considerable difficulties. When he sold out on 28th October thero was a chest of drawers, wardrobe, book case, and single. beds aud blankets, which he told tho auctioneer belonged to him ; bis wife took some furniture with her, and later took some moro ; when she heard the baliii'a were to be put in, sho took the balance claimed by her last Tuesday 18th November, he had filed on the loth. By Mr Lee: I bad a good idea of my position in July, but thought I was hotter than I had been • I have no billheads of Hart aud Co. ; Evans bill was dishonored on 4th of October and Thornton's soon after Hart's; asked Cooper for time to meet Evans' bill; wished to got a renowal for three months, and \ m Cooper said if I would pay Bocks he would X give ma time for the other; I was advised by my solicitor to pay Hart. [Mr Lough- ' nan explained that ho believed when the salo was oifeeted the creditors would bo paid in full, but was not thon aware of Moronoy's bill.] Took no steps to enquire into my position before paying Hart an d Co.
