DISTRICT COURT.
Monday, October 2.
(Before E. Hardcastle, Esq., District Judge.) [We complete our report of the District Court business commenced in last issue]. McKenzie v. Metherall.—At the conclusion of Mr Lee's cross-examination the legal points of the case were argued at length, His Honor finally giviog his decision that as there was evidence of a partnership the Court had no jurisdiction. - The case was therefore struck out. Stevens v. Miller.—Claim £51 169, balance of wages, and for meals supplied to workmen by direction of the defendant. Mr McLean appeared for the plaintiff, and Mr Cornford for the defendant. Evidence was given by the plaintiff, who had been employed by the defendant as manager of his Mount Erin property; by Mrs Stevens, the last witness' wife; and by the defendant. Counsel then addressed the Court, and His Honor went into the accounts, giving judgment in favor of the plaintiff for £20 5s 10d, with costs and counsel's fee. Mr Cornford made an application to have execution stayed uatil the next sitting of the District Court, it being the intention of Mr Miller in the meantime to proceed against the plaintiff to recover damages for the loss of some 2000 sheep sustained through bis negligence and mismanagement while manager of Mount Erin station. His Honor said that the summons bad been issued quite long enough to enable a cross action to be brought at the same session of the Court, and on ■that ground he must decline the applieafioc. The Court then rose.
