Offence Not To Have Permit

The Building Emergency Regulations, 1939, Amendment No. 4, gazetted yesterday. were referred to last evening by the Minister of Supply and Munitions, Mr. Sullivan. The Minister said the Amendment .provided that any .person who proceeded with, any constructional work in respect of which a permit or consent was required from a local authority, without first obtaining the necessary permission, committed an offence against the Supply Control Emergency Regulations, 1989. Similarly, it would .be an offence against these regulations in future for any person, who had obtained a permit or consent. from a local authority in respect ot any constructional work, to proceed with the work otherwise than in accordance with the authority given. The Minister explained' that whereas the Building Emergency Regulations required that local authorities should not issue .building permits for any constructional work without the prior consent of the Building Controller, it had been found that in those instances where buildings had (been commenced without building permits having been obtained, penalties could not the applied under the Supply Control Emergency Regulations. The only action which could' be taken was n prosecution by the local authority for a breach of its 'building by-laws. The penalties which may 'be applied, however, under the various local authority 'building by-laws were inadequate, and accordingly provision had now been made for such offences to ibe covered by the penalties provided in the Supply Control Emergency Regulations.
