In view of the novel points raised and the wide publie importance of the notion in which Constable Ernest Stewart, of Auckland, sought to recover damages for injuries received while trving to arrest a motor-car thief, his Honour, Mr. Justice Fair has decided to refer it to the Court of Appeal. Constable .Stewart’s claim is against E. G. Bridgers, manufacturer, the owner of the stolen car.
