Upheld by Supreme Court By Telegraph.—Press Association. Auckland, Dec. 10. Ills Honour Mr. Justice Smith, in a judgment to-day, dismissed an application by Wilson’s (N.Z.) Portland Cement Company to have quashed a bylaw recently made by the M liangarei Harbour Board. The by-law increased the harbour improvement rate on cement from 1/- to 1/6 per ton. His Honour said that he would be reluctant to interfere with the board’s statutory powers unless it was perfectly obvious that injustice could be proved. The Harbour Board was bound to impose different rates for different cargoes. Here there ivas no reason why it should not strive to make the users of the harbour pay for its use and for the work done to improve it.
