PROSECUTION FAILS.

Hamilton, May 16The Auckland Plumbers’ Union failed in an action against the Hamilton Hardware Company for employing a nonunionist. The defence was that the employee was engaged in 1921 before the present award came into force. He had previously been a member of the union,’ but resigned because of a fine which he considered unjust. Mr. Platts. S.M., upheld the defence and dismissed the action.
