In the Supreme Court, Marcus' Leslie Mullins, commercial traveller, applied to 1)0 declared not a resident of New Zealand within the meaning of the Military Service Ant. Plaintiff in'l his evidence stated that he arrived in Neiv Zealr.nd in October, 1915. Soon lifter ho obtained employment, • anil only lost it through circumstances connected ■ with the war. On file advice of his doctor he came to New Zealand iii the interests of his wife's health, and not possessing means sought employment here. Mr. Raymond, for the Attorney-Gen-eral. nr?ed that it would be dangerous for the' Court to <iive a definition of residence, which might later revoked. The man was enjoying the privileges ■ of the country, and was not in the position of a tourist. Mr. .Tust'ee Herdmr.n said it was dear the plaintiff nmhfc tsenn? sen-ice. Either he was an English or New Zeeland resident. Judgment was reserved.
