POLICE AND BY-LAW CASES MILK VENDOR FINED £30 At the Magistrate's Court yesterday Mr. S. J3. Jl'Carthy, S.M., presided, and dealt with the- police and by-law cases. • Lizzie Bennett was convicted of being a rogue- and a vagabond, in that 6lio possessed insufficient lawful means of support, and was sent to gaol for a, period »t twelve months. For insobriety' Evelyn Barr, against whom there were three previous convictions, was committed to the I'akaton Inebriated' Homo for a period of twelve months. William Lynch, with two previous convictions, was lined ,£5, with the alternative of serving fourteen days in gaol. • Tliero wero seven first offenders, four of whom wero each fined 10s., with the option of twenty-four hours' imprisonment, and the other three were each (hied 20s. with the alternative-of fortyeight hours' imprisonment. George Arthur Fuller visited the New Zealander Hotel on Aneac Day in an intoxicated condition, and was ejected by the licensee, but returned, and was again ejected; and on his third visit the landlord was about to eject him once more when the accused assaulted him. Ho pleaded guilty, and cxpicssed his regret for the occurrence. Ho was lined JCS, in default one month's imprisonment, and on the charge of being found drunk ho was convicted and discharged. Alfred AVilliam Wheal pleaded guilty to assaulting Joseph William Mills, in Manners Street, on Thursday. According to a witness who 6aw the incident there was no provocation to justify the assault. The defendant was fined 40s. and coats 35., in default seven days' imprisonment, aiid a prohibition order was issued against him, to be in force for twelve, months. ■\yilliani Buchan Barlow, who appeared in uniform, was charged that between March 5 and 25 at Wellington he did reuwvo lrom one I'aino and others divers sums amounting to .£1 Ss. 6d., and failed to account ior same to Thomson, Lewi.), and Co.; also on March 27 he did receive from Charles Prentzen A'l ]3s v on terms requiring uim-to ac'count for the same to Thomson, Lewis and Co., and did fraudulently omit to account for the same. Barlow pleaded guilty to both charges, and was remanded for a week in order that the matter might be reported to the military authorities. o. reservist named Hezekia'h W. J. Turner was charged with' failing to notify the Clovernmenf Statistician of his change of abode. The defendant, in pleading guilty, said he did not know that ho had to make the notification, and immediately the constable informed him of tho position ho took prompt stops to notify the Government Statistician of his new address. Ho was convicted and ordered to come up for sentence when called upon. BY-LAW CASES. E. Gallate was convicted and ordered to conio ujti for., sentence when calied upon, on a charge of Sunday tradins. Tno defendant sold some ovsters on a Sunday for consumption elsewhere than 8n tho premises. Ho said that he had been selling oysters in this way toi'_ a good niaiiy years, and this was the first timo ho had learned that it was against tho laws. Eor allowing a lorry to stand in tho street unattended, William J. Allison was lined ss. and costs 7s. William M. Barley was lined 10s. and costs lis. 6d. for leaving a motor-car 6tantling in Willis Street without lights. For driving over a street intersection at an.cicessivo speed, Eignatz V. Schramaka was fined £5 and costs 28s. 6d. Tho defendant, according to the evi- j dohce, oollided with a bicycle ridden by ' a lad, but fortunately without causing any.serious injury. For allowing a horse to wander, William F. Brown, a first offender, was convicted and ordered to pay costs 7s. MILK CASES. William Collins, ior whom Mr. H. F. O'Leary appeared, pleaded guilty to selling ice cream deficient in tno regulation percentage of cream. Mr. O'Leary said tho ice-cream supplied by the defendant was excellent, and the percentage of fat found by tho Analyst in the sample was only slightly below tho percentage fixed by tho regulations. This was not so serious a matter as the adulteration ol milk required by infants and invalids. The delendant did not know t;>at there were regulations fixing the percentage of cream, and Collins would see that no similar breach occurred again. The promises were extremely sanitary and clean, and this was admitted by Inspector Cowdrey. Tho Magistrate agreed that the matter was not very serious, and fined defendant .£2 and costs.

Gotfried A. Jorgeiisen, represented by Mr. E. M. Beechey, was ako fined 40s. and costs for a similar offence. It was stated that Jorgeiisen stipulated with thoso who supplied the milk for a high percentage of cream, so that the icecreams would bo above.the requirements, of tho regulations, but that this was not supplied to him. George Charlton, for whom Mr. A. Dunn appeared, pleaded guilty to four charges of.selling milk containing added water. Mr. J. Preudeville, of the Crown Law Office, stated that one of the samples contained 25 per cent, of added water, Mr. Dunn stated that Charlton had a small farm at Newlands, Johnsonville, and milked five cows. The defendant had no knowledge of the water being added to .tho milk; he did not add it himself, and tho only way ho could account for it was that in placing the evening's milk in tho cooler the milk can and contents wero not heavy enough to remain stable in the water, and in tilting some of tho water got into the can. Charlton was fined ,£3O and costs, to bo paid at the rate of £2 per month, on one charge, and the other threo charges were withdrawn.
