A MINER'S CLAIM
Sir, —Rii the report of niv case at the Appeal Court ia Tuesday's paper. I am credited with claiming from the company for injuries received in the course of my employment. The facts are: I wae working for the company at the time of the accident. The accident would not have happened but for neglect. 1 claimed that it was caused through nogligence o5 the company s officer, which was proved before a jury in the Warden's Court, where I got my verdict. The company appealed to the Supreme Court, with the same result. The company took it to Wellington and vroii. I am only a miner, ana have lost because I drew 30s. per week to keep ray wife and child while I was iu hospital, an act a bushuian can do and still win hie case in the same Court of Appeal. It hns been done also m Auckland, too, and the man won his caso, and it was on the strength of that case that I was advised to draw tto allowance, not knowing:a miner was any different to any other trade, w> kindly oblige mo by letting the fiubho know the facts, as they are, not m stated already a eimple accident, hut neglect, which was proved in two wATTmoN _ Westport.
