A MUCH-CRITICISED STREET CLAUSE

"AN ABSURDLY ILLOGICAL PROVISION." Councillor R. A. Wright made an emphatic protest against Section 117 of tho Pjiblio Works Act at the meeting of the City Council last-evening. He raised tho question on a decision of the By-laws Committee to ask for the exemption of Epuni Street from the operation of the •gection (which requires that all new buildings shall be set back 33ft. from the centre of the road). Councillor Wrignt said that, the people of Emmett Street, Newtown, had been' told that if they wished the council to'apply for exemption they would have to enter into an agreement to set back when they did rebuild. The trouble was that there were those in this street who would never set back, and would nevur enter into such en agreement,' so what was the use of the others entering.into any agreement to set back? It only affected those who •were likely to build. 'A voice: That's what the Act pruvides. Councillor Wright said ho did rot think- that 'was the spirit of the Act. Councillor Luckie: 'Yes, that is the spirit of the Act. Tho Mayor said that they had been going for the Government for years about the section, but had not suweeded in getting anything done. He advised Couvi-, cillor Wright to "have a go at it" in the House. . Councillor Luckie said that Section 111 was the most absurdly illogical provision I i hat was ever passed by Parliament.
