DEATH OF A HORSE.
-.APPEAL CASE. (BY TZLEGRA I'll —PRESS ASSOCIATION.! Christchurch, October 22. ■ Tho judgment of Mr. Justice Denniston in the appeal case, Edmund Manchester (appellant) v. James Moncreith Glenie (respondent), was read to the parties by the registrar. In tho lower Court the magistrate had held that the appellant had caused the death of a horso hired by him from the respondent by neglect to see that it was properly fed on tha journey, and by driving it after it had refused food and was in an exhausted condition. His lion our, .in his judgment, reviewed the facts, of the case, and found that, under Bray v. Mayne (21 Rev. Rep. 786), tho case on which the magistrate largely based his decision, a hirer had" no right to continue a journey with a horse which was exhausted, and which had refused its feed. The facts of the case supported the magistrate's decision,' and the appellant, on whom the. onus lay of disproving the negligence, had failed to do so. ' Tha appeal -was dismissed. -.
