POSITION OF NIGHT-PORTERS. , Christchurch, May 26. Tho Magistrate gave judgment to-clay i'a. the caso of the Inspector of Factories v. Manrice Lyons; licensee of the United. Service Hotel. The defendant was charged with failing to (jive an employee, a night porter, a weekly half-holiday. The Magistrates (Mr. Bishop) had followed tho decision of Mr. Riddell, S.M., in which tho latter said that tho holiday must.start from 2 p.m., and a3 a night porter was employed at night that provision did not affect him, and dismissed the case. - Tho Inspector of Factories appealed against the decision,, and tho appeal was allowed. Mr. Bishop, S.M., said that it appeared to him that when the first case was decided by Mr. Riddell, S.M., the Department sat down under an adverse decision, and took no steps to test its \Jli-! dity. Tho Magistrate in the second ct.se followed the decision in the first case, bo-, lioving that all tho points had properly been, considered. Tho caso was . published throughout the Dominion and by the Labour Department itself, and lie thought that if the Magistrate was justified in acting" on the decision surely the defendant was entitled to act similarly. CHARGE OF MURDER. THE WESTPOIIT CASE. ' Westport, May 26. Olaf Halinen 'and Andersen, seamen off the s.s. Canopus, came before Mr; llawson, S.M., to-day charged with having murdered Ernest John Bourke, on' May'B. ' Tho. evidence was heard of Connelley, who stated, as \ at the inquest, that he accompanied the' two ',- men with Bourke to M'Laughliri's cart-slied, '- and that there Bourke was struck by Anders ' sen, and struck, kicked,'and searched by Halinen. Being lengthily cross-examined, ho stated that he.had-never seen or.had drinks" with a man, who appeared in Court, :named Haakon Haakonsen, who was cook on tho barque Tacora, recently in port. Evidence' was also given by William Murray, Hugh ' Duncan, Constable Keenan, and Constable Butter mainly similar to that given' at the inquest. The, Court' then 'adjourned til? 10 a.m. to-morrow, ' MOTOR-CAR BY-LAWS. ' Dunedin, May 26. At the Police Court to-day, before Mr. EL Y. Widdowson, Herbert V. Fulton was', proceeded against by the Portobello Road Board' for. driving his motor-car on Portobello Road, leading from Dunedin to Otago Heads, contrary to tho by-laws of the Portobello Road Board. .The facts were admitted, the only point in dispute being , the validity of the , by-law. For the defendant it was contended * that the Board had power to regulate and control m&tor traffic on its roads, but- 'not ' to prohibit it; also that tho by-laws bad not been approved- by the Colonial Secretary, and that they were bad on account of un-.' certainty, as nothing could ,be found,'in the. Act showing that .the Road Board , had .any ; boundaries. Counsel for the Board contended; that the by-laws were valid, and ' that tta ', consent of the Colonial Secretary;.had been • properly given. l —Judgmont .was reserved. PUBLIC HEALTH ACT. .': Christchurch, May 26. Dr. Finch and the District Health Officer (Mr. Anthony) asked the Magistrate to-day - to make an order under Section 87-of the.' Public Health Act, 1900, for the destruction of a quantity of canned fruit, now in' the possession of F. A. Cook. It appearß, that the fruit was imported from France through a Wellington firm, but when it reached Christchurch it was found to be in; ; a state of -ferment, and- unfit for .human consumption. Mr. Cook's. manager immediately, informed, the health officer, and pro-.. . ceedings were instituted: to have, the fruit ; ; destroyed. .. , The ■ Magistrate made ,an order ~ that the-fruit should be burnt at the des-. tructor, and that defendant should pay 6d.. a case, cost'"of destroying the fruit, and Court costs. The fruit is valued 'at 13s; 6d., per dozen. .Mr. Bishop said it was rough on defendant, but could not be helped.
