Town Planning wiw Z O/STR\C'‘ PUBLIC NOTICE OF VARIATIONS TO DISTRICT SCHEME (Second review) THE COUNCIL HAS prepared fifteen variations, most of which are consequential to the hearing of objections lodged against the Second Review of the District Scheme. VARIATION No. 2 SIGNS COMMERCIAL L AND D, INDUSTRIAL L AND G This variation deals with the requirements applying to signs in the Commercial L and D Zones and the Industrial L and G Zones. In particular these requirements make specific provision for signs attached to premises, signs painted on buildings, free standing signs, sandwich boards, directory signs and business Identification signs. The variation attempts to provide a balance between current advertising practices and preserving the amenities of the District. VARIATION No. 3 DISPENSATIONS AND WAIVERS Recent Planning Tribunal and High Court decisions have highlighted the need for District Planning Schemes to provide for dispensations and waivers more precisely than has been past planning practice. In light of this and in part to give effect to some of the decisions the Council has made during the hearing of objections to the Second Review, the Council proposes to replace the existing Dispensations and Waivers Ordinance with a new one. The new ordinance sets out as precisely as possible the limits within which the Council has reserved itself discretion to relax or vary any controls in the District Scheme by means of dispensation or waiver. The Council has also been precise in stating the circumstances under which, the extent to which, and the conditions subject to which applications may be granted. VARIATION No. 4 CAMPING GROUNDS, RURAL C In recognition of the recreational potential of much of the land zoned Rural C in the Second Review of the District Scheme the Council, following the hearing of objections, believes it to be appropriate to make provision for camping grounds. To protect the sensitive environment and to ensure site suitability, the provision for camping grounds is to be by way of conditional use procedure. VARIATION No. 5 FACTORY FARMING, RURAL C ZONE This variation introduces factory farming as a use permitted in the Rural C Zone. To ensure compatibility with other land uses, the establishment of factory farms requires consent to a conditional use application. Protection is built into the ordinances by ensuring adequate separation from dwelling units and site boundaries. VARIATION No. 6 GRAZING OPEN SPACE, C ZONE AND DEFINITION In order to protect the environmentally sensitive nature of land zoned Open Space C it is intended that grazing be controlled by way of conditional use application. As a consequence, it is proposed to remove the restrictions as to the types of livestock permitted by the current definition. VARIATION No. 7 GARAGES IN FRONT YARDS, RESIDENTIAL G ZONE This variation is designed to strengthen the design and appearance controls in the Second Review of the District Scheme by making them mandatory. In particular the ordinance makes mandatory the requirement to use materials which are in harmony with the existing dwelling unit and to screen the garage from direct public view with suitable planting or fencing. VARIATION No. 8 ELDERLY PERSONS HOUSING, RESIDENTIAL G ZONE The purpose of this variation is to pevent barrack-like development where under present requirements up to six units could be constructed in one long row. The proposed ordinance amendments require a step in plan after every second unit unless there is a built in separation of 6 metres or more between units. VARIATION No. 9 HOME OCCUPATIONS, RESIDENTIAL G ZONE Arising from the concerns expressed by objectors to the provision for “home occupations” in the Second Review of the District Scheme this variation seeks to introduce a greater degree of Council control over the various uses. The variation proposes a two tier system where some specified “home occupations” will be permitted as of right while all others will require the consent of the Council to a conditional use application. Under the Reviewed Scheme as notified all “home occupations” were permitted as of right subject to certain requirements being met. This new proposal will mean the Council will have a greater opportunity to examine many of the home occupations and prevent potential nuisance before it arises. VARIATION No. 10 GENERAL ORDINANCE APPLICABLE ALL ZONES This is a minor amendment to an ordinance which applies to all zones. The ordinance gives the Council the power to vary the requirements of the Scheme in respect of applications for conditional use. The ordinance also limits the extent of variations to those which still meet the intention of the District Scheme. The amendments clarify the wording to make clear the intentions of the Scheme. VARIATION No. 11 PROVISION FOR GARAGING, RESIDENTIAL G ZONE This variation applies to the ordinances which provide for both dwelling unit and multiple dwelling unit development. The purpose of the variation is to ensure that adequate provision is made for garaging at the time dwelling units are applied for. The new ordinance requires that garaging space of 36 sq m per dwelling unit be shown on a site plan in a conforming manner if garaging is not being applied for at the time of the dwelling unit building permit application. This provision for garaging must fall within the allowable 40 per cent site coverage requirements. VARIATION No. 12 CAMPING GROUNDS, RESIDENTIAL G The Second Review of the District Scheme did not make provision for camping grounds as a permitted use in the Residential G (or any other residential zone). The purpose of the variation is to permit the establishment of camping grounds in this zone where they can meet the site suitability test of a conditional use application. Protection is built into the ordinances for adjoining properties. VARIATION No. 13 BUFFER AMENITY STRIP, RESIDENTIAL GP This ordinance amendment is designed to protect adjoining residential properties from the undesirable aspects which arise from living next door to a car parking facility. The ordinance requires a landscaped buffer strip of 2.5 metres on boundaries which adjoin a residential property. VARIATION No. 14 FORESTRY DEFINITIONS This is a technical variation designed to clarify the meaning of the terms: Conservation Forestry, Production Forestry, Protection Forestry and Woodlot Forestry. Each of these terms will be used in the Second Review of the District Scheme and for the purpose of ordinance interpretation require defining to make their meaning clear. VARIATION No. 15 YARD/EAVE OVERHANG DEFINITION This variation proposes to allow up to 0.6 m of eave to overhang any required yard. The eave overhang will not obviate the need to comply with the recession plane. VARIATION No. 16 SHAPE FACTOR, RESIDENTIAL G This variation applies to corner sites in two ways. In respect of corner sites created before October 1983 no shape factor will be required for a site to qualify for multiunit development. In the case of sites created after that date a corner site must be able to accommodate a square with a minimum side dimension of 14 metres wide to be located in any part of the site, except over the front yard in order to qualify for unit development. Details of the above described variations may be inspected at the following places at any time when they are open to the public: Waimairi District Council Offices, Corner Jeffreys and Clyde Roads, Fendalton. Waimairi District Council Parklands Office, 425 Mairehau Road. Fendalton Library, 170 Clyde Road. Redwood Library, 339 Main North Road. Bishopdale Library, Bishopdale Shopping Centre, Harewood Road. Submissions and objections to these variations or any part thereof may be made by any body or persons affected or representing some relevant aspect of the public interest. Submissions and objections shall be in writing in Form C prescribed in the First Schedule to the Town and Country Planning Regulations 1978 or to the like effect and shall be lodged at the office of the Council not later than 4 p.m. on Friday, June 13,1986. Forms for submissions and objections (Form C) are available at the Council’s Offices and Libraries listed above. At a later date every submission and objection will be open for public inspection and any body or person who wishes to support or oppose any submission or objection will be entitled to do so.
