Strenuous denial of manslaughter count

PA Wellington An engine driver, Kevin Charles; Smith, aged 25, strenuously denied the manslaughter of two railway commuters, his counsel told the Magistrate’s Court at Wellington on Wednesday. Smith, represented by Mr Graeme Mac Kay, appeared before Mr P. J. Bate, S.M. He was charged that on

March 24, by driving a shunting engine through a stop signal in the form of two red lights, he omitted without lawful excuse to perform or observe a legal duty imposed by section 156 of the Crimes Act, 1861, and thereby killed Charles Louis Henri Oosthoudevree and Ernest Bennett Goodwin and committed manslaughter. Detective Senior-Sergeant H. M. V. Burgess appeared

for the police and asked for a remand to April 3. The police had no objection to bail, he said.

Mr Mac Kay said that in view of “extensive public comment” and speculation it was important to say in open court that the defendant strenuously denied any omission to perform a legal duty.

Smith was remanded to April 3 on bail of $lOOO.
