SPECIAL ANNOUNCEMENT J. LAURITZEN LINES NEW ZEALAND/JAPAN REEFER SERVICE J. Lauritzen Lines regret that the present extreme shortage of refrigerated warehouse space in most Japanese ports and the resulting heavy shortage of both refrigerated and insulated lighters in those ports has since the middle of April caused heavy delays to all our vessels both in berthing and in discharging frozen cargoes. While we hoped these unusual warehouse and lighter conditions would soon ease, our recent careful investigation throughout Japan has regrettably revealed that the present shortage of space' is likely to continue for quite some time. We have therefore reluctantly decided until further notice to introduce a detention surcharge on all refrigerated cargo destined to Tokyo, Yokohama, Nagoya, Osaka and Kobe. This surcharge will be levied on all shipments of refrigerated cargo onboard our vessels commencing to load at the individual loading ports in New Zealand on and after 18th June, 1973. The detention surcharge will be payable by the holder of the bill of lading under the following formula:— 1 If the vessel is unable to berth within 48 hours of arrival at the individual port of discharge. as reported to the harbour master, a 10 per cent surcharge on freight (inclusive of the currency adjustment factor) will apply. 2 If the vessel is unable to berth within 144 hours of the time of arrival as mentioned above in (1) an additional 4 per cent of freight (inclusive of the current adjustment factor) will apply in respect of each 24 hours or part thereof (following the 144 hours period) during which the vessel is unable to berth. It is to be understood that non labour working holidays will be excluded. The surcharge will be collected at the time of issuance of the delivery order calculated on the estimated detention time at the discharging port concerned. In order to implement this detention surcharge in Japan it will be necessary for the following clause to appear on the face of each bill of lading:— "The holder of this bill of lading is liable to a detention surcharge of 10 per cent I on freight (inclusive Of currency adjustment factor where applicable) in the event that the vessel is unable to berth within 48 hours of arrival, as reported to the Haibour Master, at the port of discharge and that the berthing delay at the port of discharge is occasioned as the result of inadequate provision of refrigerated warehousing space ashore. The holder of this bill of lading is further liable to an additional detention surcharge of 4 per cent on freight (inclusive of currency adjustment factor where applicable) i in the event that the vessel is unable to berth on account of the afore-mentioned reason with 144 hours of arrival, as reported to the Harbour Master, at the port of discharge, for each 24 hours or part thereof (following the expiry of the • aforementioned 144 hour period) during which the vessel is unable to berth. I In the event of multiple berthing having to be made at the same port to discharge I the cargo the detention time will count from 48 hours after vessel's first arrival I at the port of discharge and any subsequent detention (S) will be added thereto. The provisions of this surcharge clause do not in any way prejudice the rights and immunities of the carrier as noted on the reverse of this bill of lading.’ The d“tention surcharge provisions noted above refer to the detention period im--1 posed on the carrier up to the time of berthing from which time the holder of the bill of lading will accept cargo as fast as vessel can deliver. W- deeply regret that circumstances have forced us to take this step but rely cn the understanding of the consignees and hope for the earliest possible easing of the space situation in refrigerated warehouses in Japan.
