CONVICTION SET ASIDE

Mr Justice Wilson yesterday set aside a conviction against Richard Bernard McKeman, of Geraldine Street, for failing to comply with a notice to present a dog for hydatids treatment.

The notice issued by the Christchurch City Council required McKeman to submit his dog for treatment between 8.30 a.m. and 12 noon on August 6, 1968. His Honour ruled that McKeman had complied with the notice in that the dog was presented for treatment although there might have been no-one with the dog. There was no requirement under the section of the Hydatids Act in question for McKeman to be present. McKernan had been convicted in the Magistrate’s Court.
