Supreme Court INDECENCY CHARGE

Judge Orders Rehearing A conviction against Murray Edward Forgie, aged 31, a radio announcer, was set aside and a rehearing in the Magistrate’s Court was ordered by Mr Justice Macarthur in the Supreme Court yesterday. Mr N. W. Williamson appeared for the Crown, and Mr J. G. Leggat for Forgie. Forgie had appealed against a conviction on a charge that on April 28 he indecently assaulted a male, and a sentence of six months gaol imposed on him in the Magistrate's Court on June 10 by Mr K. H. J. Headifen, S.M. Mr Leggat submitted that the Magistrate had misdirected himself on corroboration, and even if he had correctly directed himself his finding was against the weight of evidence, or there was insufficient evidence to meet the criminal standard of proof.
