Secretary. 3295 THE CHARITABLE TRUSTS ACT 1957 IN THE MATTER OF THE CHARITABLE TRUSTS ACT 1957 AND IN THE MATTER OF THE WILL OF JOHN YOUNG, OF CHRISTCHURCT. IN THE DOMINION OF NEW ZEALAND. RETIRED FARMER, DECEASED NOTICE is hereby given pursuant to Section 36 of the Charitable Trusts Act 1957 that the Trustees of the Will of the above-named John Young have applied to the Supreme Court at Christchurch for approval of a scheme for disposition of a certain trust property and endowment fund which on the 31st day of March, 1968. were valued at approximately $85.919 21. The said scheme provides that the Will of the above-named John Young be administered as if the following alterations had been made in it:

<a) That the first paragraph of clause I of the Will be deleted and the following substituted therefore: “As to my property situated at 43 Hackthorne Road. Cashmere, to transfer the same together with the furniture. furnishings and all other contents thereof to the Manchester Unity Welfare Homes Trust Board (Incor porated) to be held by the said Board upon perpetual trust UPON AND SUBJECT to the following conditions.’’ (b) That clause 1 (c) of the said Will be deleted and the following substituted therefore:— “That vegetarians who qualify in all other respects for admission to the said home shall be given preference over non vegetarians.” (c) That clause 1 (d) of the said Will be deleted and the following substituted therefore:— “That the said home shall be carried on under the name of ‘The John Young Memorial Hospice .” (d) That clauses 1 (e), 1 (f), 3 (b). and 3 (c 6 of the said Will and the first and second codicils of the said Will be amended by deleting therefrom wherever they appear the words Mayor, Councillors and Citizens of the City of Christchurch and substituting therefore the words the Manchester Unity Welfare Homes Trust Board Incorporated. The said scheme further pro vides that pursuant to clause 1 (e) of the said Will the Manchester Unity Welfare Homes Trust Board sell the trust property at Hackthorne Road and apply the proceeds of such sale and the said endowment fund in or towards the erection and maintenance of a hospital wing containing 20 beds to be attached to “George Manning House,** a home for the aged people to be erected on a property situate at Lyttelton Street by the Manchester Unity Welfare Homes Trust Board, such hospital wing to be operated and maintained pursuant to the trusts of . the said Will as sought to be varied and to be called “The John Young Memorial Hospice.’’ The said scheme further provides that if the capital cost of the said wing does not exceed the total of the proceeds of sale and the endowment fund any balance shall be administered by the said Manchester Unity Welfare Homes Trust Board. A copy of the said scheme has been deposited in and may be inspected at the Registry Office of the Supreme Court at Christ church. It is proposed that the application for approval be heard at Christchurch on Thursday, the Sth day of August. 1968, at 10 am. Any person desiring to oppose the said scheme is required to give written notice of his intention to do so to the Registrar of the said Court and to the Trustees of the Will of the said John Young and to the AttorneyGeneral not less than seven clear days before the date proposed for hearing of the application.
