WELLINGTON, May 10. The Court of Appeal today unanimously allowed an appeal by Douglas Ayson Bain against a sentence of two years’ imprisonment imposed in the Christchurch Supreme Court on March 10 for assault with intent to injure. Bain was sentenced by Mr Justice Macarthur on a charge of assaulting his wife, Hilda Bain.

The Appeal Court amended Bain’s sentence to 12 months’ imprisonment, to be followed by 12 months’ probation. The ground for the appeal was that in all the circumstances of the case the sentence was manifestly excessive.
