MAGISTRATES COURT Youth Fined £40 For Driving While Disqualified

"Next time—gaol,” Mr E. A. Lee, S.M., said in the Magistrate’s Court yesterday when he fined Edward Patrick Lepper, aged 17, a workman, £4O on a charge of driving while disqualified on May 27. The period of disqualification of Lepper’s licence was extended by one year. A traffic officer saw Lepper driving a car in Worcester street and knew he was a disqualified driver, said Traffic Officer A. Laing. Lepper had been disqualified for six months on February 22 for driving without a licence and he had another conviction for the same offence on March 30. DISQUALIFIED DRIVER Brian Anthony Stuart, aged 18, a storeman-driver (Mr A. Hearn), pleaded guilty to a charge that on May 22 he used a car carelessly and that he drove while disqualified. On the charge of careless use, Stuart was convicted and fined £l5, and he was disqualified from driving for three months. On the charge of driving while disqualified he was convicted, fined £35, and disqualified for one year, the disqualification terms to be cumulative.

Traffic Officer Laing said that about 7.35 p.m. on May 22 Stuart was driving south along Colombo street and came up behind a traffic patrol car. He made a violent turn to the left into Carlyle street and collided with a car travelling in the opposite direction and forced that car on to a parked car, damaging it also. Mr Hearn said that Stuart’s own vehicle was not insured and he realised that he faced a substantial period of disqualification. He asked the Magistrate to take the view that it had been stupid and thoughtless conduct, but that otherwise he was not a bad type of youth. “I suppose this has brought home to you the perils of disobeying Court orders” the Magistrate said before imposing the penalty. SENTENCE DEFERRED “But for your counsel’s submissions I would have sent you to prison,” said the Magistrate when Shirley Elizabeth Stedman, aged 25, a clerk (Mr P. F. Temper©), appeared for sentence on a charge of theft by failing to account for £517 10s between February 1 and April 1. Sentence was deferred for another week to enable arrangements for restitution to be made. The Magistrate said he had grave doubts whether Stedman’s story was true—in his view the offence was persistent stealing over a long period. Probation would not be imposed until the Court was satisfied full restitution could be made. Stedman was remanded on bail. IDLE AND DISORDERLY A 17-year-old girt, who was found in a bouse in Lincoln road, had hitch-hiked from Dunedin two weeks ago and

had not worked since, said Senior-Sergeant G. M. Cleary when Diana Marie Walsh pleaded guilty to a charge of being idle and disorderly on June 13 in that she had insufficient lawful means of support She was convicted and remanded in custody to June 21 for sentence.

Senior-Sergeant Cleary said no information had yet been received from Dunedin other than that the girl’s parents took no interest in her. ATTEMPTED CONVERSION

Eric Elliot Robinson, aged 19, a cable-laying labourer (Mr R. J. Allan), pleaded guilty to a charge that on May 28 he attempted to take a motor-car unlawfully from Hereford street He was convicted and remanded on bail for sentence on June 17. Sergeant J. M. Phelan said that about 3.25 a.m. on May 28 a constable noticed a man crouching under the dashboard of a car in Hereford street When questioned Robinson said the car was not his, and he did not have the keys for it An investigation had shown that the fuses of the car had been crossed, he said. Hugh Lean Barker, a bus driver (Mr W. F. Brown), pleaded guilty to a charge that in Papanui road he failed to stop at a pedestrian crossing for the school patrol.
