MAGISTRATE’S COURT Youth Fined £40 And Barred For Three Years

“This is one of the worst cases I have come across so far,” said Mr H. J. Evans, S.M., in the Magistrate’s Court yesterday when he convicted Brian Hay, aged 19, a clerk, on a charge of driving at a speed which might have been dangerous. Hay was fined £4O and disqualified from driving for three years. Traffic Officer R. Dellow said that at 8 p.m. on August 28 he checked the speed of the defendant's car at 55 miles an hour in Fitzgerald avenue. The check was taken over sixintersections. When stopped, Hay said he had had an argument with his girl-friend. DISQUALIFIED DRIVER

Robert John Baillie, aged 34, a driver (Mr R, L. Kerr), was convicted and fined £3O and disqualified from driving for a further period of one year on a charge of driving while disqualified. He pleaded guilty. Traffic-Sergeant H. J. McMorran said that Baillie drove in Cranford street on October 22. He told the traffic officer he had a Court order allowing him to drive in the course of his employment This was not true.

“I find it impossible to accept that there was any confusion in his mind over whether he was entitled to drive,” the Magistrate said. FINED, DISQUALIFIED

Pleading guilty to three charges arising from a collision on the corner of Innes road and Cranford street on July 30, Nuku Onehawa. aged 31, a blocklayer (Mr D. H. Hicks), was fined £25 and disqualified from driving for 18 months. He was fined £lO and disqualified on a charge of driving in a manner which might have been dangerous, £lO for failing to stop after an accident, and £5 for failing to

ascertain whether there was any injury. FOUR CHARGES Aki Mulipola, aged 35, a metal worker (Mr L. M. O’Reilly), was fined £l4 and disqualified from driving for one year when he appeared on four charges. He pleaded guilty. As a result of an accident on the corner of Barbadoes street and Tuam street on August 29, he was fined £3 10s on each of two charges of failing to give way to the right and having no driver’s licence. He was fined £3 10s and disqualified for one year on a charge of failing to give way to the right, and fined £3 10s for failing to stop after an accident. These charges resulted from a collision on the corner of Barbadoes street and Ferry road on September 11. DRIVER RTMANDED Philip Leslie Winter, aged 18, a labourer, was convicted and remanded for sentence to November 11 on charges of driving while disqualified on September 30, and failing to produce his licence for endorsement. FINED FOR THEFT Maxwell Carlton Carney, aged 41, a fitter, was fined £lO and w'as ordered to pay a witness’s expenses of £2 on a charge of stealing a wallet and a missal, of a total value of £4, the property of Colin James Vincent, at Lyttelton on October 30. He pleaded not guilty, and was represented by Mr B. J. Drake. Evidence was given that the articles were found in Carney s possession after he had been arrested on a charge of driving under the influence of drink or drugs. Vincent said the articles were in a drawer in his cabin on the m.v. Kaimai. Constable A. P. L. Cunningham said that Carney claimed that his name was Vincent when he was searched in the watchhouse. Carney later said that the articles had been planted on him and then that they had been given to him by a woman at a party on the Kaimai. Carney said he was on compensation because he had injured his back. He had been drinking at Lyttelton from 2 p.m. to 6 p.m. and then went on board the Kaimai. There were a number of men and three women in the cabin. He was drinking vodka as far as he could recollect. A girl named Maureen gave him the wallet and missal. They were going to a party in Christchurch but he left the ship when a fight started. The Magistrate said that Carney had given a variety of reasons why he had the property in his possession.
