The publisher of a forthcoming magazine, “Penthouse,” undertook in the High Court on Friday not to circulate promotional literature bearing the name of the philosopher, Earl (Bertrand) Russell.
Last Tuesday the Judge was told that Lord Russell was seriously concerned by incorrect suggestions in the promotional liteurature that he was connected with the magazine—described by counsel as “a combination of sex and erotica.” Lord Russell issued a writ against the publisher, Mr R. C. Guccione, seeking an order restraining further publication of the magazine and promotional material and claiming damages for libel and or malicious falsehood.
A lawyer for Lord Russell told the Court the undertaking would last until January 15, when it was hoped the matter would be disposed of.
