The plaintiffs had sought £75 from the trustee. They claimed that the money was proceeds of a house which the trustee had sold on behalf of their brother’s estate when it had rightly belonged to their mother, who had predeceased him. The mother had died intestate.

William Herbert Strez, a railway employee, of Leeston. withdrew as a joint plaintiff before the hearing commenced, and the claim was amended from JEII2 to £75, Another brother, Francis Adolphus Strez, a railway employee, of Christchurch, made no appearance and was not represented. In another action his Honour by consent made an order on behalf of the plaintiff, Mrs Ogilvie, as trustee of the estate of Albert Waiter Strez, a fisherman, of Leeston, barring the claims on Strez’s estate of Mrs Ingram, Miss Strez, and William and Francis Strez.

Mr H. J. B. Quigley appeared for Mrs Ogilvie, and Mr L. M. O’Reilly appeared for Mrs Ingram and Miss Strez in both actions.
