Far Too Much Noise In The Heaven And Hell

AUCKLAND, February 27. A warning to the owners of coffee shops that their premises must be licensed for entertainment, and noise kept to a reasonable level, was given by Mr H. Jenner Wily, S.M., in the Magistrate’s Court at Auckland, today. Maurice Joseph Vann, a partner in the Heaven and Hell coffee shop, was convicted and fined a total of £2O on charges under the Municipal Corporations Act and the Health Act.

Vann, who pleaded not guilty, was charged with conducting public entertainment in premises not licensed for the purpose and permitting the business to be carried on in a manner offensive to his neighbours.

The Magistrate said he was

satisfied the noise from the Heaven and Hell was excessive and was continued until the early hours of the morning.

The premises were not licensed for entertainment under the act, and the present ocupiers would have to lower the noise level or run the risk of having the premises closed.

The Magistrate said this was one of the first prosecutions of its kind in Auckland. It was a warning to others not to infringe the Municipal Corporations Act by allowing public entertainment without a licence. He fined Vann £l5 and costs of £1 10s on the charge under the Health Act and £5 and costs for conducting public entertainment in unlicensed premises.
