Marney Goes On With Action (N.Z, Press Association—Copyright) BRISBANE, May 13. The Brisbane bookmaker Tom Marney said today he intended to go on with his High Court action against the Victoria Racing Club. He was commenting on the Sydney jockey Athol Mulley’s withdrawal from the action. ‘‘l intended to clear my name,” Marney said. ‘‘The case will be heard in Melbourne this month.” Mulley and Marney claimed that the V.R.C. action on September 5, excluding them from Flemington racecourse, was a denial of natural justice and an infringement of their rights. They sought a declaration that the V.R.C. decision was “invalid, null and void.”
