MERITLESS APPEALS
Judge’s Warning At Auckland
(New Zealand Press Association) AUCKLAND, March 9.
A warning that prisoners who brought meritless appeals might have their sentences increased was given in the Auckland Supreme Court by Mr Justice T. A. Gresson. He was dismissing an appeal by Eric William Crawford, aged 34. a workman, against an 18 months’ gaol sentence for house breaking and theft.
It was a bad case of deliberate shop breaking by a man with previous convictions, said his Honour and the appeal was quite frivolous and a waste of the Court’s time. “I have power to increase sentences and had I been dealing with you in the first instance I would have sentenced you to two years’ gaol,” he said. “It is with some hesitation that I do not increase your present sentence.” His Honour added that if further meritless appeals came before him he would invoke the power he had to increase penalties.
