ACCIDENT TO FARM HAND
COMPENSATION CLAIM DISALLOWED
Holding that the plaintiff, Colin Worters, of Karamea, a farm hand, had failed to satisfy the Court that there was reasonable excuse for the delay in commencing the action, Judge Dalglish, in a reserved decision on a claim in the Compensation Court, entered judgment for the defendant, Ada Lilian Turk, of Karamea, a widow, as executrix of the estate of Cyril Frederick Turk. Evidence in the claim for compensation was heard by Judge Dalglish at Westport, Greymouth, and Christchurch in May and June this year. Mr H. A. E. Maitland appeared for the plaintiff, and Mr W. V. R. Fletcher for the defendant. Worters claimed compensation for injuries suffered in an accident arising out of his employment with the defendant on June 19, 1952. On that date, while he was in a milking shed, he was kicked on his right elbow by a cow. He required medical and physiotherapy treatment, and was in hospital from November 17, 1952, to January 13, 1953. During this time, he received no compensation. He claimed compensation for this period and also for a permanent part-incapacity caused by the accident. Pari: of the defence .was- that the plaintiff failed to commence the action for compensation within six months after the date of the accident, as required by the act. The accident occurred on June 19, 1952, and the action was not begun till August 7, 1953.
